There are several kinds of bail exist in United States today. The level of seriousness of the case and the arrestee’s criminal history determine the total bail amount. And in many cases, the accused can use a combination of the following bail types.
• Cash - When the bail amount is small, some people choose to pay their bail in cash. When the case comes to a closure, they are able to get their money back.
• Citation Release (Cite Out) - In this case, the person violated certain laws and is immediately cited by an arresting officer. The arrested person is then given a citation note, describing the violations and court date.
• Property Bond - The accused person or a close family relative of the accused pledges real property, such as cars or houses that has a value at least equal to or twice the total bail. If the accused person decides not to show up in court on assigned date, the state takes the property away.
• Immigration bond - Immigration bond is very different than other types of bail. In this case, it involves Immigration and Customs Enforcement. The arrestee of such case is not a legal immigrant of United States, thus may face deportation at the end of trial.
• Surety Bond - Surety bond also means surety on bond or bail bond. A third party, like a bail bond company helps to bail out the arrested out of jail. During this process, instead of paying the whole bail amount, a family member or a friend of the accused only need to pay 10% of the total bail to the bail bond company. However, if the accused decide to flee from court date or disappear during trial, the bail bond company loses the whole bail amount to the state.
• Recognizance (Released on Recognizance) - When a person is arrested, he is booked and taken to jail. There is no bail involved. The person is released upon promising he would return to court. In many states, though the person is released on his own recognizance he is forbidden to leave the area until investigation is over.
When a person is said to be ‘release on bail’, it usually means the person has paid the total bail either by cash or property that assure the accused will return to court for trial. If the person is able to pay off his bail, he can get his money back when the case comes to closure. However, there are many people who are not able financially afford the total amount of bail, especially the amount of bail is in thousands of dollars, thus they would prefer to pay a small percentage of the total bail to a bail bond professional. The only difference is the amount paid to the bail bond agent is not refundable.
